01Agreement to Terms

MindScout (mindscout.net) is run by Kintu Games, a sole proprietorship (eenmanszaak) run by Roman Berdichevskii, registered with the Dutch Chamber of Commerce (KVK) under number 85932698, Vennewaard 378, 1824 KN Alkmaar, the Netherlands ("we", "us"). By using MindScout you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use MindScout.

You must be at least 16 years old to create an account.

02User Accounts

You need an account to submit apps, follow apps, send feedback and buy boosts. You are responsible for:

• Giving accurate information and keeping it up to date
• Keeping your sign-in details secure
• Everything that happens under your account
• Telling us straight away about any unauthorised use

03Submitting Apps

Makers can submit their own apps, and anyone can submit an app they discovered as a Scout. Whoever submits an app must make sure its details are accurate and that they have the right to share the text, logos and screenshots they upload.

We review every submission before it is published and may approve it, ask for changes, reject it, or later archive or remove it, at our discretion. Review usually takes 1-3 business days, but we do not guarantee a time or an outcome.

To present apps consistently, we may:

• Resize and compress logos and screenshots, and edit listings to fix errors or formatting
• Show public information from the App Store and Google Play next to an app, such as ratings, prices, developer name, ads and in-app purchases
• Add referral parameters to links, so that makers can see visits that came from MindScout

04Your Content

You keep ownership of what you submit. You give us a non-exclusive, worldwide, royalty-free licence to host, store, back up, reproduce, adapt the format of and display it on MindScout, and to feature listings in our guides, our emails and our social media posts. The licence ends when the content is removed from MindScout, except for backups and posts already published.

05Likes, Leaderboard and Badges

• Approved apps join the leaderboard of the month in which they are approved and are ranked by community likes.
• Each person can like an app once. Likes from visitors who are not signed in are limited per IP address.
• After each month ends, the top two apps win a Monthly winner badge that the maker can show on their own site. Badges have no monetary value.
• Boosts, store ratings and prices do not change the ranking.
• We may remove likes, exclude an app from a leaderboard or withdraw a badge if we believe likes were manipulated or these Terms were broken.

06Information on MindScout

Rankings and guides reflect community likes and public store information. They are not product testing, and nothing on MindScout is medical, psychological or professional advice. Apps listed on MindScout are made by third parties: we are not responsible for them, their content, their pricing or their privacy practices, and your use of them is between you and their makers.

07Boosts

A boost promotes an approved app for a fixed number of days. We offer:

Important: Only apps with Approved status can be boosted, and each app can have one boost at a time. A boost does not add likes and does not change leaderboard or guide rankings.

The boost period starts as soon as your payment is confirmed. We decide the exact position and design of Featured spots, which may change over time, and Featured spots may be hidden when a visitor filters the home page by a category that does not match your app.

08Payment and Billing

• Prices are shown in USD on the promote page, before VAT. Applicable taxes are calculated and added at checkout, where you see the final price.
• Business customers can enter a tax ID at checkout.
• Payments are made by card through our payment processor, Stripe.
• Boosts are digital promotional services, not physical goods.
• We may change prices at any time; a change never affects a boost you have already paid for.

09Refunds and Right of Withdrawal

Boosts are non-refundable once they have started, except as described below.

Consumers in the EU normally have 14 days to withdraw from an online purchase. Before paying for a boost, you ask us to start it straight away and confirm that you lose this right of withdrawal once the boost has started.

• If a technical problem on our side keeps your boost from being shown, we will extend it or give you a full refund.
• Any other refund is at our discretion.
• If we remove an app because it breaks these Terms, its boost ends without a refund.

For any problem with a boost, email hello@mindscout.net before contacting your bank.

10Prohibited Activities

You may not:

• Break any law or regulation
• Impersonate others or submit apps or content you have no right to share
• Submit misleading, illegal, hateful or harmful content
• Manipulate likes or rankings, for example with bots, multiple accounts or paid likes
• Spread malware or interfere with how MindScout works
• Scrape MindScout in bulk without our permission
• Get around our payment system or request chargebacks for boosts that were delivered

11Termination

You can stop using MindScout and ask us to delete your account at any time. We may suspend or close your account, or remove your content, if you break these Terms or the law, or to protect MindScout and its users.

12Disclaimer and Liability

MindScout is provided "as is". We work to keep it available and accurate, but we do not guarantee that it is always online, error-free or that the information on it is complete. As far as the law allows, our total liability to you is limited to the amount you paid us in the 12 months before the claim. This does not limit liability for intent or gross negligence, or any rights you have as a consumer that cannot be limited by law.

13Intellectual Property

MindScout, its design, text, guides and badges are owned by us and protected by copyright and other laws. App names, logos and screenshots belong to their owners.

14Changes to Terms

We may update these Terms as MindScout changes. The date at the top shows the latest version, and we will announce significant changes on the site or by email. Boosts you have already paid for stay under the Terms that applied when you bought them.

15Governing Law

These Terms are governed by Dutch law. Disputes go to the competent court in the district of Noord-Holland, the Netherlands. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and can also bring a claim there.
